Four Cleveland-area women are seeking class-action status for their lawsuit alleging state taxes on tampons and other feminine hygiene products is discriminatory. The suit filed in the Ohio Court of Claims seeks an end to the so-called "Pink Tax" and the refund of at least 66 million dollars to female consumers. The US Food and Drug administration classifies tampons as "medical devices" - a category that is largely exempt from state sales taxes. Two pending bills would lift the tampon tax, and the tax on disposable diapers. Pennsylvania, Maryland, Massachusetts, New Jersey and Minnesota have already repealed the tax, as have Canada and Australia.
