Judge Reschedules Hearing On OSU's Request To Dismiss Jon Waters' Lawsuit

A federal district judge has rescheduled a hearing to weigh Ohio State University's request that a civil rights lawsuit by former marching band director Jon Waters be dismissed. Judge James Graham will now hear arguments April 10. Waters sued for reinstatement last year, accusing the university, President Michael Drake and a provost of discriminating against him by disciplining him differently than a female employee. Waters also claims the defendants denied him due process. The university says Waters was an at-will employee who could be fired for any reason.. Waters was terminated last July after the university said he concealed a "sexualized" band culture and misled school officials. Waters recently re-applied for the job.
