OSU Asks Judge To Dismiss Waters' Lawsuit

Ohio State University attorneys are asking a judge to dismiss a lawsuit by former marching band director Jon Waters, who was fired for allowing a "sexualized culture" within the band. Waters was fired in July 2014 after the university says he mishandled sexual discrimination allegations and ignored provocative band traditions such as hazing that included members marching in their underwear. Waters denied wrongdoing and filed a federal civil rights lawsuit claiming reverse gender discrimination. The university's request to dismiss the suit was filed under seal March 15th and is not public. The document's existence surfaced in a separate filing seeking an extended timeline for responses. A university spokesperson said he could not comment on litigation. The court gave Waters until May 6th to oppose the school's motion.
