SUPCO Rules In Criminal Records Sealing Case Involving Fairfield County Man

supremecourt.ohio.gov

The Ohio Supreme Court has ruled criminal cases may be sealed immediately upon dismissal even if charges could be refiled. The justices say state law only requires judges to determine if a timeline for refiling charges has expired. The decision upholds the 2015 request of a Fairfield County man to seal records in his case after charges including arson, aggravated menacing and domestic violence were dropped. The ruling settled disagreements between two lower courts.
