Judge Dismisses State Lawsuit Against Rover Pipeline Builders

A Stark County judge this week dismissed a lawsuit Ohio filed against the developers of the 4.2 billion dollar Rover natural gas pipeline that stretches from West Virginia to Michigan. 

The lawsuit sought to force Dallas-based Energy Transfer Partners to pay fines for what Ohio regulators said were numerous water pollution violations during construction. The judge ruled the Ohio Environmental Protection Agency waived its right to regulate construction under the Clean Water Act. The builders argued it was up to the Federal Energy Regulatory Commission to enforce environmental laws during construction. The Ohio Attorney General's office is reviewing the decision and is considering its next step.
