Judge Rejects Pharmacies Motion To Dismiss Opioid Litigation

A federal judge overseeing opioid litigation in Cleveland has ruled against a request by five pharmacy chains to dismiss lawsuits filed by Lake and Trumbull Counties. 

The lawsuits scheduled for trial next May claim the dispensing practices by CVS, Walgreens, Rite Aid, Walmart and Giant Eagle were a public nuisance under Ohio law. The chains argued in their motion to dismiss nuisance laws don't apply. The counties' lawsuits were the first to target pharmacy chains as both distributors and dispensers.
