Judge Says Minority Set-Asides For Medical Marijuana Licenses Unconstitutional

A Franklin County judge has declared unconstitional a state requirement that 15 percent of medical marijuana licenses go to minority-owned groups. 

Judge Charles Schneider said the provision denied Greenleaf Gardens of its rights because two lower-rated, minority-owned firms were chosen instead. The state asked the court to reject the lawsuit, arguing a state license isn't a federal right. The Ohio Department of Commerce says it is reviewing the ruling.
