Judge Says Otte's Reaction During Execution Was Not Sufficient To Stop It

A federal magistrate judge has ruled the physical reaction of death row inmate Gary Otte during his execution earlier this month was not sufficient to stop it under current state law governing lethal injections. Michael Merz also says it was likely too late for him to act by the time Otte's attorneysreached him by phone. His attorneys said there were signs Otte was crying, clenching his hands and that his stomach was heaving.
