SUPCO: Fan Injured By Foul Ball May Purse Damages Against Cleveland Indians

The Ohio Supreme Court has ruled a New York man hit by a foul ball and blinded in one eye at a Cleveland Indians game may seek damages from the club. 49-year-old Keith Rawlins says stadium personnel distracted him during the July 2012 game by forcing him to relocate for a post-game fireworks show. The team says Rawlins voluntarily left the area. A state appeals court reversed a lower court's decision that cleared the Indians  based on a baseball rule that bars injury claims against teams. That rule is contained in the fine print on every game ticket issued. The high court has upheld the reversal.
