The U.S. Supreme Court has declined to hear an appeal by an Upper Arlington Christian school trying to move into a building zoned for commercial use.
Tree of Life purchased the former AOL/Time Warner building in 2010. The city says a rezoning would forgo income tax revenue. A lower court ruled against Tree of Life last September, saying it failed to show discrimination against its rezoning application. Tree of Life argues the city would allow non-profits or day care centers in the zoning area.
