The man charged with Upper Arlington's first murder in eight years is free on his own recognizance.
A judge yesterday set bond at 1.5 million dollars for 51-year-old Jeffery Smith, who is charged with stabbing and killing 31-year-old Charles McCoy Monday during a fight outside a West Lane Avenue restaurant. Police say the fight resulted from a dispute over a romantic relationship. He was freed by prosecutors after Smith's attorney said his client is the victim of mistaken identity, and there is video evidence Smith was not on the scene at the time. Smith is due back in court on June 22.
