Court Overturns Conviction Of Alleged Drunken Driver

The 12th Ohio District Court of Appeals has overturned the conviction of a motorist who prosecutors say killed a husband and wife when he ran over their motorcycle while drunk in Madison County two years ago. The court say the judge at 34-year-old Timothy Ackley's trial failed to tell him about the prison terms that would be in play when he pleaded guilty. 56-year-old Mark Williams and his 51-year-old wife Jo Ann of West Jefferson were struck by a speeding and intoxicated Ackley on Route 142. It is not clear if prosecutors will seek a new trial.
