SUPCO Sets Aside Portion Of Sexual Assault Law


The Ohio Supreme Court has thrown out part of a state sexual assault law requiring a mandatory sentence when prosecutors provide corroboration of evidence. At issue were arguments that corroboration bears no relationship to the severity of a crime and also creates an improper distinction with cases where evidence is not corroborated. The court's ruling, which addressed Ohio's gross sexual imposition law, also rejected corroborating evidence as a sentencing tool in plea deals where a jury did not consider the evidence. The decision overturned a 2012 three-year prison sentence for a Franklin County man. The ruling returns the case to a county judge for resentencing.
