The 6th U.S. Circuit Court of Appeals in Cincinnati has sent  a wrongful death lawsuit filed against two white Columbus police officers in the shooting death of a black man back to federal district court for more consideration.

23-year-old Henry Green was killed in 2016 by  undercover officers Zachary Rosen and Jason Bare. The lawsuit filed by Green's mother alleged the cops continued to shoot Green after he was going to the ground. The court says the cops had time to reassess Green’s alleged threat to their lives. Rosen and Bare were cleared of criminal and departmental charges. The judges do not believe the officers should be granted qualified immunity.
