Legislation Would Allow Same-Sex Couples To File Joint State Tax Returns

Legislation proposed by statehouse Democrats would allow same-sex couples to file joint state tax returns. The move would bring the state in line with a U.S. Supreme Court decision permitting them to jointly file federal taxes. Backers say the bill could be enacted despite a 2004 voter-approved state constitutional amendment banning same-sex marriage. Backers say same-sex couples are being forced to prepare two different sets of tax returns, meaning extra costs for hiring someone to handle their taxes. The Ohio Department of Taxation maintains that state law and the constitution only permit joint filing by married couples. The measure likely will not be approved by the Republican-dominated Legislature.
