State Seeks Dismissal Of Lawsuit Prompted By Botched Execution

The state is asking a federal judge to dismiss a lawsuit filed by the family of Dennis McGuire, who repeatedly gasped and snorted during his January execution. The lawsuit alleges unconstitutional pain and suffering. The state says the lawsuit was improperly filed because McGuire's son is not arguing his own constitutional rights were violated, and because the suit fails to list the specific acts executioners committed. The Ohio Department of Rehabilitation and Corrections has changed its policy to boost the dosages of lethal execution drugs in the future.
