BWC Settles Lawsuit Concerning Premium Overcharges

A Cuyahoga County judge has approved the Ohio Bureau of Workers' Compensation settlement of a class-action lawsuit claiming it overcharged employers hundreds of millions of dollars over several years. The deal creates a 420-million-dollar fund to repay 270 thousand businesses that were overcharged for workers compensation premiums from July 2001 to June 2009. An appeals court had ruled the agency set up an illegal rating system that resulted in employers being overcharged nearly 860 million dollars. Bureau administrator Steve Buehrer says the agency has made major changes to its system since then.

Last year the agency set aside 860 million dollars in preparation for a court ruling.
