A federal district judge has refused to dismiss a North Canton telemarketing millionaire's conviction on a witness tampering charge. Attorneys for 72-year-old Ben Suarez say the charge was based on faulty jury instructions. A federal jury in June acquitted Suarez of all other counts regarding allegations that he used employees, relatives and others to illegally donate 100 thousand dollars each to the 2012 U.S. Senate campaign of Republican state treasurer Josh Mandel and the 2012 campaign of former Ohio Republican Congressman Jim Renacci. Prosecutors say Suarez wanted their help with a civil complaint filed against his California company. Suarez is scheduled to be sentenced on November 14.
