An appeals court has dismissed an appeal by a former Ohio National Guard Major from Marysville sentenced to life in prison for sexually abusing his three adopted daughters. An attorney for 43-year-old Jean Kruse argued the evidence didn't support the conviction, he had ineffective legal counsel and the children recanted their accounts. Kruse's wife, who is serving prison time in the case, testified she never saw signs of such abuse. The appeals court says the case wasn't fully resolved at the county level, as the jury deadlocked on one charge that hadn't yet been retried or dismissed.
