Anti-Fracking Group To Appeal Judicial Dismissal Of Lawsuit

A community activist group in Broadview Heights that opposes oil and gas wells in residential neighborhoods says it plans to appeal a judge's decision to dismiss its lawsuit. Mothers Against Drilling in Our Neighborhood claims the city's Community Bill of Rights supersedes a state law permitting fracking. The measure was approved by voters in 2012 and banned future wells. But a Cuyahoga County Common Pleas judge recently dismissed the lawsuit, citing a February Ohio Supreme Court case that said municipalities' home rule rights do not overrule state law regulating fracking. The justices gave the state sole and exclusive authorization to permit, locate, space and regulate the wells.
