Special Prosecutor Says Columbus Cop May Not Be Charged With Dereliction Of Duty

A special prosecutor hired by the Columbus City Attorney's office says a Columbus police commander should not be charged with dereliction of duty after sending emails containing allegations of child abuse to his junk folder. 

The prosecutor says the statute of limitations has not expired for any possible charges, but there is no probable cause to charge Mark Gardner. Democratic State Representative Bernadine Kennedy Kent and others accused Gardner last year of dereliction of duty after he said in a 2014 deposition he sent her emails to his junk folder. Police had previously determined the statute of limitations had passed. Kennedy-Kent says she's disappointed with the ruling.
