Evidence shows that a white, now former University of Cincinnati police officer was wearing a T-shirt with a picture of a Confederate flag on it when he shot and killed an unarmed black man during a traffic stop last year. A photo of the black T-shirt with the flag and the words "Great Smoky Mountains" was presented during a crime scene technician's testimony Friday at the trial of fired Officer Ray Tensing. He has pleaded not guilty to charges of killing Samuel DuBose. Tensing contends he was dragged by the victim's vehicle and felt his life was threatened. A prosecution expert witness says Tensing's body camera video of the shooting contradicts his argument. A use-of-force expert hired by the prosecution testified DuBose did not present a threat to Tensing at the time of the shooting. Consultant and Post Falls, Idaho police chief Scot Haug testified DuBose was not being compliant but that does not justify the shooting. Haug says Tensing could have responded to the situation differently.

The presiding judge issued a gag order to attorneys for both sides, citing only "the issues that have arisen" in explaining her decision.
